1. OPERATIONAL GOVERNANCE & JURISDICTION
1.1 The Evolve Standard
Evolve Eco Surface Preparation and Restoration ("The Company") operates as a premier provider of mobile industrial cleaning, abrasive blasting, and surface restoration services across Western Canada. We conduct operations at the intersection of strict regulatory compliance and high-performance industrial standards. Our governance framework is designed to exceed the requirements of the Alberta Occupational Health and Safety (OH&S) Act, the Personal Information Protection Act (PIPA), and the Consumer Protection Act.
1.2 Service Territory & Jurisdiction
While headquartered in Edmonton, Alberta, our mobile service fleet operates comprehensively across the Western Canadian Sedimentary Basin. All Terms of Service and contractual obligations are governed by the laws of the Province of Alberta. Any legal disputes arising from commercial surface preparation, residential restoration, or industrial plant maintenance shall be adjudicated within the courts of Edmonton.
2. ENHANCED PRIVACY POLICY (PIPA & PIPEDA)
2.1 Data Collection for Industrial & Residential Sectors
In strict accordance with Alberta's Personal Information Protection Act (PIPA) and federal PIPEDA regulations, we adhere to a policy of Data Minimization.
- Industrial Clients: For plant turnaround projects and shutdown maintenance, we may collect and encrypt sensitive operational data, including site access codes, procurement officer credentials, and proprietary coating specifications.
- Residential Clients: To facilitate log home restoration or driveway paint removal, we collect property geolocation data and access protocols.
2.2 Cross-Border Data Processing & Sovereignty
To maintain the efficiency of our mobile dispatch logistics and CRM systems, certain operational data points may be processed by secure third-party vendors (e.g., cloud-based field service management software) hosted outside of Canada. By engaging Evolve for surface prep services, you acknowledge and consent to this necessary operational data transfer, understanding that such data may be subject to the legal jurisdictions of the host country.
2.3 Cybersecurity & Document Retention
We employ enterprise-grade encryption to protect all digital assets, including Hazardous Materials Assessments and Contractor Safety Orientation records. Client data is retained only for the duration required by the Limitation of Actions Act or relevant taxation statutes, after which it is securely destroyed via cryptographic erasure.
3. TERMS OF SERVICE & "FAIR TRADING" COMMITMENT
3.1 Scope of Work & Change Management
Evolve provides specialized services including, but not limited to: Dustless Vapor Blasting (Slurry Blasting), Dry Ice (CO2) Cleaning, Mobile Fleet Degreasing, and SSPC-Compliant Surface Preparation.
The "Fair Estimate" Guarantee: In alignment with the Alberta Consumer Protection Act, we guarantee that the final invoice for services will not exceed our written estimate by more than 10%, provided the scope of work remains unchanged.
Change Orders: Any deviation from the original scope—such as the discovery of hidden rot, unforeseen coating layers (e.g., lead-based paint encapsulation requirements), or client-requested expansion of the blast zone—will trigger a formal "Change Order" process. Additional work will proceed only upon verbal or written authorization.
3.2 Force Majeure & Weather Protocols
Operating in the harsh climate of Northern Alberta requires operational resilience. While our mobile blast units are winterized for hot water pressure washing and steam cleaning, we reserve the right to invoke Force Majeure clauses in the event of:
- Ambient temperatures dropping below -30°C (critical equipment threshold).
- Active lightning risks threatening scaffold operations or crane-assisted blasting.
- Severe blizzard conditions impacting site access or visibility.
Note: Rescheduling due to Force Majeure is done without penalty to the client.
3.3 Cancellation Policy
We respect the scheduling constraints of our industrial partners and homeowners. Cancellations made with at least 24 hours' notice incur no penalty. Cancellations made within the 24-hour mobilization window may be subject to a "Call-Out Fee" to cover crew dispatch and fuel logistics.
4. OPERATIONAL SAFETY & "AUDIT-READY" FRAMEWORK
4.1 The "Zero-Harm" Culture
Safety is not merely a policy; it is our license to operate in the energy, mining, and municipal sectors. Evolve maintains an internal Health & Safety Management System (HSMS) rigorously aligned with the standards of the Alberta Construction Safety Association (ACSA).
4.2 Enhanced Safety Documentation Available
We believe in radical transparency regarding risk management. Upon request by Safety Officers, Prime Contractors, or Homeowners, Evolve can immediately provide "Enhanced Documentation" packages, including but not limited to:
- Site-Specific Safety Plans (SSSP): Custom risk mitigation strategies for high-risk zones.
- Field Level Hazard Assessments (FLHA): Real-time, daily hazard scans conducted by our crew leaders.
- Safety Data Sheets (SDS): Full chemical transparency for all blast media (e.g., Recycled Glass, Walnut Shell, Garnet, Corn Cob).
- Safe Work Procedures (SWP): Codified protocols for Confined Space Entry, Working at Heights, and High-Pressure Blasting.

4.3 Regulatory Alignment (COR & ISN)
- COR Compliance: Our internal protocols regarding hazard assessment, competency verification, and incident investigation are built to meet or exceed Certificate of Recognition (COR) auditing standards.
- ISNetworld / ComplyWorks / Avetta: We maintain an administrative structure prepared for immediate verification and subscription to major industrial contractor management platforms upon the award of qualifying contracts. We are "Audit-Ready" for Grade A compliance.
5. QUALITY ASSURANCE & SERVICE STANDARDS
5.1 Standard of Care & SSPC/NACE Alignment
We strive for perfection in every coating removal and surface profiling project. Our technicians are trained to adhere to industry-recognized standards, including SSPC (Society for Protective Coatings) and NACE (National Association of Corrosion Engineers) specifications for surface cleanliness (e.g., SP 6 Commercial Blast, SP 10 Near-White Metal).
5.2 Limitation of Liability & Pre-Existing Conditions
While we exercise the highest "Standard of Care," Evolve acts as a surface preparation contractor, not a structural engineer.
- Substrate Integrity: We are not liable for pre-existing damage (e.g., wood rot, concrete spalling, masonry fatigue) that is revealed during the cleaning process. The act of removing a coating may expose underlying structural flaws for which the Company cannot be held responsible.
- Fugitive Dust & Containment: While our vapor blasting technology suppresses up to 95% of airborne dust, total containment is physically impossible in open-air environments. We employ "Best Available Technology" (BAT) to mitigate overspray but cannot guarantee a clean-room environment in outdoor settings.
6. INSURANCE & RISK TRANSFER
6.1 Scalable Liability Coverage
We understand that industrial facility maintenance carries inherent risks. To protect our clients, Evolve maintains a robust, scalable insurance portfolio designed for the high-risk demands of the Alberta energy sector.
- Coverage Limits: We carry adequate Commercial General Liability (CGL) coverage, scalable from $1 Million to $10 Million to specifically meet the vendor qualification requirements of major oil & gas operators, municipalities, and EPC contractors.
- Specific Inclusions: Our policy structure specifically covers operations including mobile pressure washing, abrasive blasting, environmental cleanup, and completed operations liability.
- Indemnification: We agree to indemnify and hold harmless the Client against claims arising directly from our proven negligence or willful misconduct.
Certificate of Insurance: Certificates of Insurance (COI) with specific project endorsements and additional insured status are available upon request for qualifying contracts. All documentation required per scope is provided within 24-48 hours of request.
